AGREEMENT TO TERMS
These Terms of Use constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and Crafts by Zinn ("Crafts by Zinn", "we", "us", or "our"), a business operating from Hanoi, Vietnam, concerning your access to and use of the www.craftsbyzinn.com website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the "Site"). You agree that by accessing the Site, you have read, understood, and agreed to be bound by all of these Terms of Use. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS OF USE, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SITE AND YOU MUST DISCONTINUE USE IMMEDIATELY.
We reserve the right, in our sole discretion, to make changes or modifications to these Terms of Use at any time and for any reason. We will alert you about any changes by updating the "Last updated" date of these Terms of Use. It is your responsibility to periodically review these Terms of Use to stay informed of updates. You will be subject to, and will be deemed to have been made aware of and to have accepted, the changes in any revised Terms of Use by your continued use of the Site after the date such revised Terms of Use are posted.
The Site is intended for users who are at least 13 years of age. All users who are minors in the jurisdiction in which they reside (generally under the age of 18) must have the permission of, and be directly supervised by, their parent or guardian to use the Site.

INTELLECTUAL PROPERTY RIGHTS
Unless otherwise indicated, the Site is our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the "Content") and the trademarks, service marks, and logos contained therein (the "Marks") are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws. The Content and the Marks are provided on the Site "AS IS" for your information and personal use only. Except as expressly provided in these Terms of Use, no part of the Site and no Content or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission.
Provided that you are eligible to use the Site, you are granted a limited license to access and use the Site and to download or print a copy of any portion of the Content to which you have properly gained access solely for your personal, non-commercial use. We reserve all rights not expressly granted to you in and to the Site, the Content and the Marks.
USER REPRESENTATIONS
By using the Site, you represent and warrant that: (1) all registration information you submit will be true, accurate, current, and complete; (2) you will maintain the accuracy of such information and promptly update such registration information as necessary; (3) you have the legal capacity and you agree to comply with these Terms of Use; (4) you are not under the age of 13; (5) you are not a minor in the jurisdiction in which you reside, or if a minor, you have received parental permission to use the Site; (6) you will not access the Site through automated or non-human means, whether through a bot, script or otherwise; (7) you will not use the Site for any illegal or unauthorized purpose; and (8) your use of the Site will not violate any applicable law or regulation.
If you provide any information that is untrue, inaccurate, not current, or incomplete, we have the right to suspend or terminate your account and refuse any and all current or future use of the Site (or any portion thereof).
PRODUCTS
We make every effort to display as accurately as possible the colors, features, specifications, and details of the products available on the Site. However, we do not guarantee that the colors, features, specifications, and details of the products will be accurate, complete, reliable, current, or free of other errors, and your electronic display may not accurately reflect the actual colors and details of the products.
BLIND BOX COLLECTIBLES
Many products sold on our Site, including Sonny Angels and other collectible figures, are sold as blind boxes. Products identified as "Blind Boxes" contain randomized contents that cannot be selected or guaranteed prior to purchase. By purchasing blind box items, you acknowledge and agree that:

You cannot choose, request, or guarantee which specific figure, character, variant, or design you will receive

Each blind box contains one random figure from the series

The contents are not revealed until you open the package

There is always a possibility of receiving duplicate figures, even when purchasing multiple boxes

Factory-sealed cases typically contain one of each regular figure in a series, but rare or secret figures may randomly replace regular figures

Some collectors have reported receiving duplicate figures even in sealed cases

We make no guarantees regarding the contents of blind boxes or sealed cases
All products are subject to availability, and we cannot guarantee that items will be in stock. We reserve the right to discontinue any products at any time for any reason. Prices for all products are subject to change.

You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Site. You further agree to promptly update account and payment information, including email address, payment method, and payment card expiration date, so that we can complete your transactions and contact you as needed. All payments shall be in U.S. dollars.
You agree to pay all charges at the prices then in effect for your purchases and any applicable shipping fees, and you authorize us to charge your chosen payment provider for any such amounts upon placing your order. We reserve the right to correct any errors or mistakes in pricing, even if we have already requested or received payment.
We reserve the right to refuse any order placed through the Site. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed for the purpose of unauthorized commercial resale.
RETURN AND REFUND POLICY
Please review our separate Return and Refund Policy posted on the Site. While we generally do not offer returns or exchanges on collectible items, we will work with customers on a case-by-case basis for issues such as damaged items, shipping errors, or defective products. Contact us within 7 days of receiving your order if you believe there is an issue.
PROHIBITED ACTIVITIES
You may not access or use the Site for any purpose other than that for which we make the Site available. As a user of the Site, you agree not to:

Systematically retrieve data or other content from the Site to create or compile a collection, compilation, database, or directory without written permission from us

SITE MANAGEMENT
We reserve the right, but not the obligation, to: (1) monitor the Site for violations of these Terms of Use; (2) take appropriate action against anyone who violates these Terms of Use; (3) refuse, restrict access to, limit the availability of, or disable any content; (4) remove from the Site or otherwise disable files and content that are excessive in size or burdensome to our systems; and (5) otherwise manage the Site in a manner designed to protect our rights and property and to facilitate the proper functioning of the Site.
PRIVACY AND DATA PROTECTION
We care about data privacy and security. By using the Site, you agree to our collection and use of your personal information as described in our interactions with you. We collect only the information necessary to process and fulfill your orders, including name, shipping address, email address, and payment information. We do not sell or share your personal data with third parties except as necessary to fulfill your orders (such as sharing your address with shipping carriers).
INTERNATIONAL SALES
We ship internationally from Vietnam. International customers are responsible for:

Any customs duties, import taxes, or fees charged by their country

Understanding their country's import regulations for collectible toys

Providing accurate shipping information, including any required customs documentation
We are not responsible for delays caused by customs processing or packages refused due to unpaid customs fees.
TERM AND TERMINATION
These Terms of Use shall remain in full force and effect while you use the Site. We reserve the right to, in our sole discretion and without notice or liability, deny access to and use of the Site to any person for any reason, including for breach of these Terms of Use or of any applicable law or regulation. We may terminate your use or participation in the Site or delete your account at any time, without warning, in our sole discretion.
MODIFICATIONS AND INTERRUPTIONS
We reserve the right to change, modify, or remove the contents of the Site at any time or for any reason at our sole discretion without notice. We also reserve the right to modify or discontinue all or part of our products or services without notice at any time. We will not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the Site.
We cannot guarantee the Site will be available at all times. We may experience hardware, software, or other problems or need to perform maintenance related to the Site, resulting in interruptions, delays, or errors. You agree that we have no liability whatsoever for any loss, damage, or inconvenience caused by your inability to access or use the Site during any downtime or discontinuance of the Site.
GOVERNING LAW
These Terms of Use and your use of the Site are governed by and construed in accordance with the laws of the Socialist Republic of Vietnam.
DISPUTE RESOLUTION
We value our customers and want to resolve any issues amicably. If you have a dispute with us, please contact us first via email craftsbyzinn@gmail.com, so we can attempt to resolve the matter directly.
For disputes that cannot be resolved directly, you agree to first attempt good-faith negotiations for at least 30 days before pursuing any formal legal action.
Any legal disputes shall be resolved in accordance with Vietnamese law through the appropriate courts or arbitration bodies in Hanoi, Vietnam.
CORRECTIONS
There may be information on the Site that contains typographical errors, inaccuracies, or omissions that may relate to product descriptions, pricing, availability, and various other information. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update the information on the Site at any time, without prior notice.
DISCLAIMER
THE SITE IS PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. YOU AGREE THAT YOUR USE OF THE SITE AND OUR SERVICES WILL BE AT YOUR SOLE RISK. TO THE EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SITE AND YOUR USE THEREOF, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We make every effort to provide accurate product information and reliable service, but we cannot guarantee that all information will be error-free or that the Site will be available without interruption. We are not responsible for delays, errors, or issues beyond our reasonable control.
LIMITATIONS OF LIABILITY
To the extent permitted by Vietnamese law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Site.
Our liability to you for any cause whatsoever shall be limited to the amount paid by you, if any, for the specific product or service giving rise to the claim.
Nothing in these Terms of Use shall exclude or limit our liability for fraud, death or personal injury caused by our negligence, or any other liability that cannot be excluded or limited under Vietnamese law.
USER DATA
We will maintain certain data that you transmit to the Site for the purpose of managing the performance of the Site and fulfilling your orders. Although we perform regular backups, you are solely responsible for all data that you transmit or that relates to any activity you have undertaken using the Site. You agree that we shall have no liability to you for any loss or corruption of any such data.
ELECTRONIC COMMUNICATIONS
Visiting the Site, sending us messages via social media, and completing online forms constitute electronic communications. You consent to receive electronic communications, and you agree that all agreements, notices, disclosures, and other communications we provide to you electronically satisfy any legal requirement that such communication be in writing.
MISCELLANEOUS
These Terms of Use constitute the entire agreement between you and us regarding use of the Site. Our failure to exercise or enforce any right or provision of these Terms of Use shall not operate as a waiver of such right or provision. If any provision of these Terms of Use is determined to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of any remaining provisions.
